Definitions

"Service" means the bill payment service offered by Telstar Cable Limited through its www.TelstarJamaica.com website ("the website"), and a reference to the "Service" includes Telstar Cable Limited, as the context may require.

"Agreement" means these Terms and Conditions of the Service which are legally binding on you and the Service once you give a Payment Instruction or other information on the website.

"Payment Instruction" means the information provided by you to the Service for a bill payment to be made.

"Business Day" means every working day, Monday through Saturday, excluding public holidays.

"Scheduled Payment Period," means the period of two Business Days after your credit card is debited within which, subject to the provisions hereof, your account with Telstar Cable Limited shall be credited with your payment.

"Due Date" means the date reflected on your statement on which a payment is due. This is usually the first day of the month.

"Scheduled Payment" means a payment that has been scheduled through the Service but which has not been processed.

"Account Number" means your Telstar Cable Limited Account Number.

Return Policy

In using the Service, you understand and agree that Telstar may return payments for various reasons such as, but not limited to:
(a) Your Account Number is not valid;
(b) Your other payment details are incorrect.

In all cases, Telstar Cable Limited will use its best efforts to assist with the successful completion of your transaction, or void the transaction and return the appropriate credit to your credit card.

Cancellation Policy

If you have completed a credit card transaction, Telstar will require a minimum notice period of 24 hours for cancellation. Notification via email and/or fax, will be accepted subject to confirmation in writing. We reserve the right to levy a charge to cover any consequential administrative expenses.

Termination of Agreements and Refunds Policy

Both Telstar and yourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes underway. Any monies that have been paid to Telstar Cable Limited which constitute payment in respect of the provision of unused services shall be refunded.

Commitment Statement for rapid order processing

You are solely responsible for paying your Telstar bills on or before the Due Date.
Due to circumstances beyond the control of the Service, particularly delays in handling and posting payments by the various financial institutions or other technical delays, there may be delays in the crediting of some transactions to your Telstar account. Telstar cable will make every effort to credit your account within one business day of receiving notification of your transaction. Telstar Cable shall not be responsible for any account credit delays that are outside of its control.

When Telstar Cable receives a Payment Instruction from you, you thereby authorize Telstar Cable to charge your credit card and remit funds on your behalf so that, subject to the terms and conditions herein contained, your account shall be credited within the Scheduled Payment Period. You also authorize the Service to effect a credit to your credit card for payments returned to you by Telstar.

Telstar agrees not to initiate or make any payments under your credit card on its own volition and without your authorization. Telstar will provide you with the relevant billing information.

The Service will use its best efforts to make all your payments properly. However, the Service shall incur no liability whatsoever for any loss, damage, expense or cost of any kind, and any Service guarantee shall be void and of no effect if the Service is unable to complete any payment initiated by you because of the existence of any one or more of the following circumstances:

1.Through no fault of the Service, your credit card does not have access to sufficient funds to complete the transaction or the transaction would exceed the existing credit limit on your credit card;
2.The payment-processing centre is not working properly and you know or have been advised by the Service about the malfunction before you executed the transaction;
3.You have not provided the Service with the correct name, address, phone number, or Telstar Account Number or information, or if any other information provided by you is incorrect; and/or,
4.Circumstances beyond the control of the Service (such as, but not limited to, fire, flood, break or surge in electricity supply or interference from an outside force) prevent the proper execution of the transaction.
Provided that none of the foregoing exceptions are applicable, if the Service causes an incorrect amount of funds to be removed from your credit card or causes funds from your credit card to be deducted in a manner which does not comply with your Payment Instruction, the Service shall be responsible for returning the improperly transferred funds to your credit card, and for correcting any previously misdirected transactions, and, if applicable, for absorbing any late payment related charges, fees or penalties. This shall be the extent of the liability which the Service will incur under the above circumstances.

Commitment Statement for quick response to customer service emails and calls Refund Policy

In case of errors or questions about your transactions and/or service, you should as soon as possible notify us via one of the following:

  2. Contact us by using the application's e-messaging feature;

In cases where you think your statement is incorrect or you need more information about a transaction listed on the statement, you must contact us no later than five (5) days after the FIRST statement was posted on which the problem or error appears.

You must:

  1. Tell us your name and Account Number if known;
  2. Describe the transaction in question, and explain as clearly as possible why you believe it is an error or why you need more information about the transaction or service; and
  3. Tell us the dollar amount of the suspected error or disputed transaction

If you advise us verbally, we will require that you send your complaint in writing within two (2) Business Days after your verbal notification. We will tell you the results of our investigation within three to five(3-5) Business Days after we hear from you, and will correct any error promptly. Notwithstanding the foregoing, if we require more time to confirm the nature of your complaint or question, we reserve the right to take up to forty five (45) days to complete our investigation. We will provisionally credit your credit card within three to five (3-5) Business Days for the amount you think is in error. If we ask you to submit your complaint or question in writing and we do not receive it within two (2) Business Days, we may not provisionally credit your credit card. If it is determined that there was no error we will  provide you electronically or by mail with an explanation within three (3) Business Days after completion of our investigation. The Service will revoke any provisional credit provided to you if we find that an error did not occur.

Refunds will be provided for the following reasons:

  1. If an area is unserviceable
  2. If the customer cancels his/her installation before the scheduled date
  3. The account has been permanently disconnected and has a credit balance

Once Telstar receives your refund request we will check your status in our automated billing system to verify the claim before we process any refunds. Once the claim has been verified and the refund has been approved, the refund will be processed in time for payment to the customer within seven business days of approval. Payment cancellations must be made prior to the next scheduled bill.

Statement of what type of transaction security is supported

The Telstarjamaica.com domain is secured by a VeriSign SSL Certificate offering 40-bit minimum to 256-bit SSL encryption. SSL enables an encrypted communication channel between your Web browser and the Web site server so that you can transfer sensitive information securely. When you send sensitive information,like a credit card number, encryption keeps it private.

Statement to retain a copy of transaction

Telstar will retain payments records for a minimum period of seven years.
